1. Acceptance of Terms

By accessing or using Etym ("Service"), operated by Unary Works LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Etym is a design token extraction tool that analyzes publicly accessible websites and extracts design system information including colors, typography, spacing, and other visual properties. The Service consists of:

• A web application for viewing and managing design reports
• A Chrome browser extension for initiating website analysis
• Server-side analysis APIs that process extracted data

3. Account Registration

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration.

4. Acceptable Use

You agree not to:

• Use the Service to violate any applicable law or regulation
• Analyze websites in a manner that disrupts or overloads target servers
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Use automated tools to access the Service beyond the provided extension
• Resell or redistribute the Service without written permission
• Use the Service to collect personal data from websites without authorization

5. Intellectual Property

Your content: You retain ownership of any design tokens and reports generated through your use of the Service. You may use extracted design data for your own projects.

Our platform: The Service, including its software, design, logos, and documentation, is owned by Unary Works LLC and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without permission.

Third-party content: The Service analyzes publicly accessible websites. Design elements extracted from third-party websites remain the intellectual property of their respective owners. You are responsible for ensuring your use of extracted design data complies with applicable laws and the rights of third parties.

6. Third-Party Websites

The Service interacts with third-party websites for analysis purposes. We do not control, endorse, or assume responsibility for the content or practices of any third-party websites. Your use of the Service to analyze third-party websites is at your own risk.

7. Plans, Billing, and Refunds

Free and Pro Plans

Etym offers a free plan with limited monthly report credits and a paid Pro plan with a higher monthly credit allowance. Plan details, pricing, and credit limits are displayed on our Pricing page and may be updated from time to time.

Billing

Pro subscriptions are billed on a monthly or annual basis, depending on the billing cycle you select at checkout. Payments are processed through our third-party payment provider. You agree to provide accurate billing information and authorize recurring charges for your subscription.

Cancellation

You may cancel your Pro subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to Pro features until that date. No partial refunds are provided for unused time within a billing period.

Credit Limits

Report credits reset at the beginning of each calendar month. Unused credits do not roll over. If you exceed your plan's monthly credit limit, you will need to wait until the next reset or upgrade your plan.

8. Service Availability

We strive to maintain the Service's availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time without notice. We are not liable for any downtime or service interruptions.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR THAT ANALYSIS RESULTS WILL BE ACCURATE OR COMPLETE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNARY WORKS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Termination

We may terminate or suspend your account at any time if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through the account settings page or by contacting us. If you have an active Pro subscription, termination will cancel your subscription effective immediately.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised date. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Sheridan County, Wyoming.
